Law Case Digest Essay

In 1977, four loans from Allied Banking Corporation which is enclosed by four promissory notes amounting P100, 000 each was acquired by Elias Q. Tan, then President of Lapu-lapu Foundation, Inc. The bank was inhibited to file with the Regional Trial Court of Cebu City, Branch 15, a protest in looking for payment by Tan and the foundation, jointly and solely, of the sum of P493, 566.61 representing their attorney’s fees and costs, loan obligation, penalty charges, exclusive of interests. For the reason that as of January 23, 1979, Tan and the foundation were not able to pay the whole obligation with a total of P493, 566.61 and regardless of the demands made on them by the Bank. The foundation denied of acquiring the indebtedness from the Bank as their answer to the complaint. They said that the loans were obtained by Tan in his personal capacity, for his own use and benefit and on the strength of the personal information he provided the Bank. The Foundation upheld that it never gave Tan authorization to co-sign in his place as its President any promissory note and that the Bank is fully aware that the loans contracted were made in Tan’s personal capacity and for his own personal use and benefit and that the Foundation never benefitted, directly or indirectly in any way or manner, thereof. The Foundation then interjected a cross-claim against Tan declaring that he, going beyond his authority, should be solely liable for the said loans, and a counterclaim against the Bank for damages and attorney’s fees. For Tan’s part, he admitted that he committed the loans from the Bank in his personal capacity. The parties, however, agreed that the loans were to be paid from the proceeds of Tan’s shares of common stocks in the Lapu-Lapu Industries Corporation which is a real estate firm. The loans were covered by promissory notes which were automatically rekindled every year at an amount which includes the unpaid interest, until the time that Tan would be able to pay the same amount from the proceeds of his abovementioned shares. According to Tan, the employee of the Bank required him to attach two signatures on every promissory note, giving him guarantee that the loan documents would be filled out in accordance with their agreement. Yet, after he signed and delivered the loan documents to the Bank, these were filled out not in accord with their agreement, wherein the Foundation was included as party. Further, previous to its filling of the complaint, the Bank made no claim on him. After the trial, the court handed over judgment. First, obliged Tan and the Foundation to pay jointly and solely to the Bank the principal obligation for the four promissory notes in the amount of P 493, 566.61 which includes all their charges included in the same, with 14% interest per annum, computed from January 24, 1979 until the same are fully paid, with an additional 2% service charges and 1% monthly penalty charges. Second, the court obliged Tan and the Foundation to pay jointly and solely, attorney’s fees in the equivalent amount of 25% of the total amount due from them on the promissory notes, including all charges and lastly, both Tan and the Foundation are obliged to pay jointly and solely proceedings expenses of P 1,000.00 plus costs of the suit. The CA supported with modification the judgment of the court by deleting the award of attorney’s fees in the favor of the Bank so that there will be no bias. The petition for review on certiorari was filed by Tan an d the Foundation. ISSUE: 1. Whether Tan and the foundation should be held jointly and solely liable. 2. Whether the foundation gave Tan an apparent authority to deal with the Bank. RULING: 1. As it is in the doctrine of corporate entity, the court did not make a mistake in holding Tan and the Foundation jointly and solely liable. Given these circumstances – Tan representing himself as the President of Lapu-Lapu Foundation Inc., Tan opening a savings account and a current account in the name of the corporation, signing the application form as well as the necessary sample signature cards twice for himself and the Foundation, and Tan submitting a notarized Secretary’s Certificate from the corporation, attesting that he has been authorized to sign for and in behalf of the Lapu-Lapu Foundation any and all checks, drafts or other orders with respect to the Bank; to perform business with the Bank, negotiate loans, agreement, obligations, promissory notes and other commercial documents; and to initially acquire a loan of P100, 000.00 from any bank – Tan and the Foundation cannot hide under the corporate veil. Because of the transactions Tan entered on the behalf of the Foundation, the Foundation is deemed liable. 2. According to the Secretary’s Certificate, Tan, the President, was given supposed and clear authority by the Foundation to, among other things, deal with the Bank. For that reason, the Foundation is prohibited from questioning the authority of Tan to attain the subject loans from the respondent Bank. Since it is a known doctrine that if a corporation knowingly allows one of its officers, or any other agents, to act within the scope of a noticeable authority, and holds him out to the public as someone who holds the power to do those acts, the corporation is prohibited from denying the agent’s authority.

The Rap Culture and Today’s World

The Rap Culture and Today’s World The culture of rap was redefined when the music group N. W. A. released their debut album, Straight Outta Compton. This groundbreaking album was the center of controversy across the nation. Critics argued that gang violence, drug use, and crime were idolized in the group’s lyrics. Even the name of the rap group, Niggaz Wit Attitudes, sparked major controversy nationwide. This album began the evolution of the rap culture; a culture that has seen a rapid increase in popularity since the 1980s and exerts a major influence on the youth of today.Lil Wayne’s CD, Tha Carter III, was one of the most anticipated albums of all time for any music genre, showing the popularity and the influence of rap music on today’s world. Although rap music is seen by some as liberating and empowering, rap has helped create a culture in our society that idolizes gang activity, drug use, crime, and has a degrading view of women. Dwayne Michael Carte r Jr. , formally known as the rapper Lil Wayne, was born on September 27, 1982 in New Orleans, Louisiana. Lil Wayne grew up in one of the poorest neighborhoods in New Orleans, Hollygrove.Hollygrove is notorious for its crime rates and poverty level. Wayne was no different from his neighbors, as he had many run-ins with the law. Lil Wayne has also publicly acknowledged his affiliation with the Bloods, the biggest criminal gang in America. He commonly mentions the Bloods in his songs and some of the criminal activity they have become infamous for. Also, Lil Wayne’s drug use has been well documented over the years. You can often see Lil Wayne smoking marijuana while being interviewed on radio broadcast or on the internet. The way Lil Wayne lives his life is portrayed in his music, just as most musicians put a personal twist on their art. With response to the influence of rap, Raquel Alvarenga states: â€Å"The lyrics of popular rap artists like Nelly and Jay-Z are much more than straightforward commentaries on social class inequity and the hardships of urban life†(13). Youth growing up in poverty stricken areas can relate to the words rappers â€Å"preach†. Many rappers have come from the ghettos across America, and speak of the illegal and illicit activities they used to participate in.The youth idolize these figures not only because they made it out of the hood, but because they glamorize the very same criminal activities youths are participating in. Much of the youth growing up in the ghetto resort to gang activity because they lose hope and believe that crime and selling drugs are the only viable options to making it out of the ghetto. Rap stars are idolized by the youth, and whether they want the responsibility of being a role model or not, it comes with the territory of the rap game.Additionally, rappers are notorious for their lyrics about â€Å"pimps and hoes†. Amongst other degrading things, half naked women are commonly found in rap music videos shaking their butts. Rap lyrics often refer to women as â€Å"hoes†, â€Å"tricks†, or â€Å"bitches†. Alvarenga says that â€Å"These lyrics, teeming with sexually explicit messages, encourage the subjugation of women and promote an ethos of disrespect against them† (13). The role of women has changed significantly over the last 20 years, but not the view and respect level given to them by their counterparts. It is hard to have respect for women that are showing more and more skin and beginning to do promiscuous things that have never been acceptable in the eyes of older generations. The culture of rap music has helped shaped the behavior and perception of women nowadays. Gang Activity has always been a substantial part of the rap culture, as many rappers come from a gang related backgournd. Most rappers have some association with a gang; whether they are a member or they represent them in their music.Top 6, a gang out of the Lake Wort h area, is famous for creating and producing their own music. Their music is center around the drugs they sell, hatred for other gangs, and crimes they have committed. Being that rappers have strong affiliation to gangs it is inevitable that gang life is portrayed in their music. The youths that listen to these rappers’ music think that it is acceptable to participate in gang activity since their favorite rappers are doing it. Drugs have always played a pivotal role in rap culture, as many rappers support drug use and selling drugs.Rappers often explain in their lyrics how they made it through the urban struggle by selling a multitude of drugs including marijuana, cocaine, and creak. Young Jeezy, a rapper from the Atlanta area, made millions by selling cocaine before he became a rapper. He often refers to his days as a cocaine dealer in his music. Many rappers have faced jail time during the height of their careers for drug related charges, including Lil Wayne who faced charg es in 2010 for marijuana possession.Drugs have always had a place in society, but there has never been an influx of celebrities that openly acknowledge drug use and selling drugs like many rappers do. The glamorous portrayal of drugs in the rap culture is harmfully impacting today’s society. Tha Carter III was released in the summer of 2008 and debuted as the number one album on the US Billboard 200 by selling over a million copies in its first week. A seemingly innocent baby picture of Lil Wayne can be found on the album’s cover, but anyone who has a deeper understanding of the rap culture knows this picture is not so innocent. There are multiple tattoos on the face of the baby, but the tear drops below his eye spark the most controversey. The tattooing of tear drops below the eye has become a popular tradition of the Bloods after they commit their first real act of violence or murder. By having a deeper understanding of rap music and familiarizing yourself with the ra p culture, you can then understand all messages found in rap lyrics and the potentially harmful effects they could have on audiences. The rap culture continues to have a negative impact upon all social classes. Urban youths believe the only way out of ghetto is through gang activity or striking it rich in the rap game. With a large fan base of rap coming from white, middle class suburbs, we are also seeing a lessening respect towards women and who are viewed as nameless and faceless objects. Even though some view the rap culture as a way of freely expressing yourself, rap has created a culture in our society that glamorizes gangs, drugs, crime, and has a degrading view of women.Rap music has become a multi-million dollar industry and is no longer considered a fad, but a mainstay in our world. With this realization, we must weigh the cons and pros that come with rap music and the culture it has created. As J. Annette Saddik explained, â€Å"Ice Cube was careful to make a distinction between occasions when rapper are just having fun and when they are performing more serious social messages†(110). Society, especially the youth, cannot continue to take the messages rappers are giving literally and try to imitate the lifestyles being portrayed in their music.Today’s society is walking a thin line when it comes to the ideals and values that rap music is instilling into the youth that could have potentially harmful effects for future generations. Revision Changes: For the most part this essay was well written. There were not as many typos and grammatical errors as the first two. I thought I developed the ideas nicely and made a good connection between rap culture and society. Some of my transitions in the paper did not flow as well as I hoped. I added more substance to these sentences in hopes of making my paper less choppy. The most challenging part of revising this particular work was making my transitions stronger and rewording sentences where I was go ing off topic or sounded wordy. Overall, this is the work I was most pleased with over the course of the semester. Music vs. Books Essay

We live in the age of information; where our generation needs some sort of communication in various ways. Weather it may be through music or books, there are several variations on communication, just depends on how you want to target them in order to get the information across. Both music and books have similarities as well as differences. Each has its’ own advantages and disadvantages. Music produces sound that is also a form of art, where books are illustrated pieces of paper which are presented in a different way than music; such as written form. Music and books can have advanced effects on your life in different ways, like music can have more of an effect on you then a book would. With in doing so comparing the two; they have both been traced back in time to as far as the ninth century B. C. , Books back then had been written on stone, tree bark, metals and clay while music had been around for about forty thousand years. Both music and book have been passed down from generation to generation. Music from where it started until today has many genres such as; Jazz, Hip Hop, Rap, Folk, Oldies, County, R&B, and so much more, books come in various ways such as; magazines, news papers, and journals. Due to its advantages, music is considered more. Music has an advantage where it uses sound while books use the eyes to relay the messages, for some people hearing is an advantage to seeing and vice versa. In order to read a book you have to be educated where music you don’t need the prior education, and you only have to understand the music to understand the message the singer is putting across. Books will give you information that you are looking for while music gives you the information while as entertaining you at the same time. Many people at one time can listen to much while with a book only one person can MUSIC VS. BOOKS 3 read it at a time. Some books can carry hidden messages that the author is trying to get across, while music is direct and to the point. Books tend to stimulate mental journeys and expanded awareness of realities different from our own. This is a very true statement, because a person can use his or her own experiences and compare them to a different reality. When a person reads about an explorer and his many adventures, it can make he or she think about testing their limits and own abilities and go out and pursue their own journeys. Both books and music need parental guidance. There are so many different vulgarities that song writers and authors use, it makes parents worry about what their children read and/or listen to. Different types of music can give either a negative or positive impact on people, sometimes music can give both negative and positive impacts. It truly depends on how a person interprets a certain song or lyric. Books have almost the same affect as music in this aspect. Books can be very useful and eye-opening, and they can also be misleading. Most generally non-fiction books and biographies tend to be useful, where fictional books can be misleading, for example, a book can say that there are talking bears when in reality bears and other animals do not have this ability. Music and books can be great influences as well as bad influences sometimes. It all depends on how a person acts, reacts, and interprets what he or she reads or hears. Both music and books can impact a person’s life in a positive way. Music allows someone to express themselves and his or her emotions. A book allows a person to escape reality and enter into an alternate reality, and allows his or her mind to partake in events that they would never be able to in real life. Gender, politics, and citizenship Essay Example | Topics and Well Written Essays - 1000 words

Gender, politics, and citizenship - Essay Example This is women activist implemented liberation movement that focused on women rights. Understanding the way racism, class, ethnicity and sexual orientation interconnect with gender issues are significant in creating a social meaning and political effects; thus providing active citizenship engagement in the contemporary society. The two readings of Lowe and Davis are complementary for understanding gender, politics and citizenship because this is one way of informing development policy. 0.. The two readings from the Davis and Lowe make an attempt of revealing the way gender affects women more than many in the society. The author’s main point revolves around gender politics and the political figures of women. This is through exposing us to the women’s liberation movement as a way of fighting for civil rights and working class issues in society. Both authors try to unmask the side of fighting for women’s suffrage. This ties the issues of anti- slavery especially for Asian immigrants and the introduction of anti- slavery activist for the purpose of struggling for the women’s suffrage. They attempt to reveal the way racism, ethnicity, class and sex differences have divided members of women movement. Other main arguments involve cultural differences and linguistic forms of a nation that creates contradictions in the political sphere. It also creates impact on citizenship towards the identity of a nation. Both authors also focus on women’s history, suffrage and work coalitions. Davis and Lowes’ readings are complementary for understanding gender, politics or citizenship. This is because the three terms as being described in the two readings seem to work side by side. They are interwoven in a manner that reveals the way gender affects women’s roles and their status in the society. Davis (2) defines gender by focusing on race and class as the aspects that contribute to political differences among various citizens. She reve als the way racism and class contributes to social and cultural differences. These inequalities contributed to political issues whereby women activist in history during the women’s emancipation made an attempt of maintaining justice. The abolitionist movement aimed to address issues that women are undergoing including the education inequalities and voting rights. Therefore, under the prominent women activist such as Elizabeth Candy and Susan Anthony among others, women were able to achieve their rights. This marked the new beginning of political history whereby women were allowed to enjoy similar opportunities like men. Moreover, both authors attempt to define gender as socially constructed norms, values and ideologies that determine the behaviors or action of male and female in the society. Understanding the notion behind gender issues is significant in determining power dynamics behind an individual’s access towards resource sharing or distribution, the ability for o ne to make the decision and the way different sexes are impacted by the political process or social development. They define gender aspects on citizenship as the affirmation or exercising  the  rights  of women in order  to promote equality. For instance, women tend to be more discriminated than men in the society, in all key aspects including education, political issues and decision making process. They take fewer controls on economic and political resources; thus incorporating gender aspects and political issues into programs

Information Technology and Social Trends Essay Example | Topics and Well Written Essays - 1500 words

Information Technology and Social Trends - Essay Example Project can broadly be defined as a specific time bound work with specific objectives and goals; budget; and resources (Reynolds, 2010). Project management helps provide the tools to achieve project goals through well planned strategy. It normally encompasses essential steps like: feasibility study of the project; project development; production and implementation process; monitoring and control mechanisms; and successful completion that leads to the smooth running of the project. Thus, effective management of project is critical to the successful delivery of its goals and objectives within the limited resources of time, budget and human capital. The Project Manager helps coordinate the various team issues of the project, which are vital part of project dynamics that facilitate wider understanding and promote improvement and improvisation of the process to achieve project goals and objectives more efficiently. ‘Access to information represents the basic precondition for success of a firm’ (Drucker, 1998). The access to information becomes vital to only promote efficient and knowledge based discharge of duties by the team but also a great tool for the management to exploit the available information to improve its performance. Hence, Information System Development helps in storing and manipulating strategic business information that are designed to improve the overall business prospects. The proficiency in using computers greatly facilitates the project manager to tacitly exploit data to identify the risks and shortcoming so that they can be addressed timely. When IT system is introduced, training on the use of hardware and software becomes intrinsic part of implementation. Barton emphasizes that ‘hands on real time interaction with the new system†¦ with a more broad based understanding of the flow of information through the system’ is needed (Barton, 2001). TQM promotes quality assurance at various levels of project processes

DQ1_Wk6 - Essay Example The decisions are not always taken in the correct manner and hence at times there are serious issues as per their adherence. The standards and procedures need to be followed to the hilt so as to make adequate arrangements for liaising with the people who matter the most. These channel members could be the wholesalers, distributors, retailers or the middlemen who are involved under these channel dynamics. When it comes to branding itself, channel decisions take the front seat and thus become all the more important. (Paley, 2006) Bypassing middlemen in order to save costs and reducing on time constraints might just be the order of the day but then again if the same decisions do not bring in the much needed effectiveness and efficiency for the branding that has been done for a product, the manufacturer might just do away with this issue once and for all. He would resort to employing all the channel members to ensure that his branding ideology is manifested in the most righteous way and that there are no hiccups in the wake of achieving the targets set forth by the manufacturer or the parent organization. There are advantages and disadvantages alike of this bypassing middlemen scenario. Distribution channel model talks about the different retailers, wholesalers and distributors who make the process of transfer of products between the manufacturer and the customer possible. The different means and ways to get in touch with the customers is thus the responsibility of these channel members. The company’s m arketing as well as the distribution strategy is completely focused upon in this business model. There is more accessibility for the channel members that include the retailers, distributors, wholesalers and even the third parties. The relationships have changed between the channel members and are quite apparent by the fact that at many places within the distribution chain we find that there is horizontal and vertical

Jazz Essay Example | Topics and Well Written Essays - 750 words

Jazz - Essay Example Wild is a unique woman who exhibits several literary features of a character known as Beloved in a previous novel. The similarity in the features of the two character is a strategy that the author uses to provide solutions to the problems he leaves unresolved in the previous novel as discussed in the essay below. Suspense is an artistic style employed by authors to sustain readership. It refers to a manner of developing a conflict and leaving it unresolved with a promise to resolve it in the next episode. Most authors address numerous conflicts in their storyline. They introduce multiple conflicts in a single chapter and leave them unresolved. The desire to determine the solution to the conflicts motivates the audience to continue reading to the next chapters. Morrison employs the strategy on a different scale as he uses the technique to join two separate novels. He uses hypothetical features of the character in the first novel, Beloved is an equally unique woman with most of her features such as the weird color of her skin resembling the color of Wild in the Jazz. Morrison refers to Wild’s skin color as coal black’ (Morrison 171]), this provides an outright connection with the first novel in which a female character entitled Beloved exists and performs mystical roles. The mystic nature of Beloved is similar to the nature of Wild in Jazz. The name Wild is appropriate since the woman disappears to the wild soon after giving birth to her son. She is therefore a wild woman whom the rest of the characters in the novel do not understand. Beloved was a spirit in the previous novel, she was equally unknown to the rest of the characters in the novel with most of the characters interacting with her only in their dreams. The similarity in their roles and features is a means the author uses to provide some of the soliloquies that audience may hold while reading the first novel. By portraying Wild as an actual character in Jazz, the author provides the audience

Closing the Output Gap in the United Kingdom Essay

Closing the Output Gap in the United Kingdom - Essay Example Of course, actual output is the recorded GDP of a given time that can be in nominal or real values. The nominal value refers to the prefers of the GDP synchronic to the prices or price reference of a given year while the real GDP can be valued in terms of a base or a reference prices of a reference year. Dornbush et al. (2008, p. 15) explained that the concept of an output gap provides a way of measuring the magnitude of the cyclical deviations of actual output from the potential output. The concept â€Å"potential output† is also interchangeable with the term â€Å"trend output† (Dornbusch et al. 2008, p. 15). From the economic perspective of Dornbusch et al., the output gap is negative during a recession and positive during an expansion (2008, p. 15). In a recession, resources are unemployed and actual output is below potential output. In contrast, during a positive gap or expansion, workers overtime and machineries are utilized more than the usual (Dornbusch 2008, p. 15). Positive gap or expansion is also known as an economic recovery (Dornbusch 2008, p. 15). For Mankiw (2006, p. 425), potential output or full employment output is more accurately the natural rate of output because â€Å"it shows what the economy produces when the unemployment is at its natural or normal rate†. At the same time, Mankiw pointed out that â€Å"the natural rate of output is the level of production toward which the economy gravitates in the long run† (2004, p. 425). According to classical viewpoint, the potential output or the natural rate of output depends on labour, capital, natural resources, and technological knowledge and, therefore, shifts in the potential output or natural rate of output depend on changes in the said variables (Mankiw 2004, p. 425). An output gap can promote price volatility.

Cause and Effect Essay Example | Topics and Well Written Essays - 750 words - 6

Cause and Effect - Essay Example However, there is also an underlying anxiety about entering a new and unfamiliar world full of new challenges; and a hint of doubt about one’s ability to manage so many new challenges. Suddenly being pitched from the comfort of familiarity into a bewildering world inhabited by people from different cultures and communities – a world full of innumerable choices and temptations could be daunting. Another factor to be considered is that parents too are proud of the achievements of their youngster and getting ready to give him/her more freedom albeit with a touch of anxiety. Under these circumstances, living with parents during one’s college years can have many benefits both for the parents as well as the student. A student on the threshold of college life looks forward to an exciting new phase of independence and new and varied experiences. However, transition from high school to college could be tough; considering that one suddenly is looked upon as a responsible adult. However the freedom one has from strict parental control can be very welcome. Yet, freedom brings with it the weight of responsibility too when one has to take the consequences of one’s actions. Juggling finances and striking the right balance between academics and the hectic social and co-curricular activities, and yet making time to focus on studies in order to get good grades, cannot be easy. The sudden exposure to new people, who may be from varied cultures and backgrounds, new ways of learning when one cannot depend on notes given by teachers, and a different social and cultural life, can be overwhelming. Choosing new friends with common interests and adding others who can aid in your personal development are exciting and fun but can drain one physically and emotionally. Hence having the familiarity of family to comeback to everyday can be a huge relief. One can get gradually acclimatized to new responsibilities and a new social and academic culture while still

Reading the Constitution Essay Example for Free

Reading the Constitution Essay In their essay, How Not to Read the Constitution, Lawrence Tribe and Michael Dorf describe the ways the Constitution has been interpreted by different people. Tribe and Dorf make it clear that the idea that the Constitution should be interpreted based on what the framers original intent was is not the way to read the Constitution, it takes much more than that. Tribe and Dorf also explain that justices do not interpret the Constitution in a way that would please the readers (the people) on purpose, because if that were so then the authority of the Constitution would lose all legitimacy if it really were only a mirror for the readers ideals and ideas (p. 49). This means that people have the tendency to interpret the Constitution based on their own beliefs. Also, the justices themselves have their own beliefs and their own interpretations of the Constitution, but they should not come up with a decision based solely on their own opinions. The exact way to read the Constitution is indefinable, therefore in their essay, Tribe and Dorf instead described how not to interpret it and implied that justices should make wise decisions that are not entirely based on their own beliefs, the original intents of the framers made generations ago, or the expectations of the public now. In the case Planned Parenthood of Southeastern Pennsylvania v. Casey, Planned Parenthood was challenging a Pennsylvania law that placed some restrictions on abortion. Many opponents of abortion hoped that the Supreme Court would use the case to strike down the decision made in Roe v. Wade, which states that a state ban on all abortions is unconstitutional. The majority of the court voted not to do so. This is a good case for providing insight into the way justices interpret the constitution and make their decisions. Justice of the Supreme Court Sandra Day OConnor wrote the majority opinion for the case. The majority voted not to overrule the decision made in Roe v. Wade. OConnor wrote on behalf of the majority and wrote in the opinion that the main reasons for this decision were based on the principle of stare decisis and the fact that the cases central ruling is workable for the states and does not come at odds with other precedents. Also, OConnor wrote that the word liberty from the statement no state shall deprive any person of life, liberty, or property, without due process of law, (the Due  Process Clause of the Fourteenth Amendment) includes a womans right to an abortion. Thus, the precedent decision made in the case Roe v. Wade that deals with the rights to and restrictions on abortion still stands. Justices William Rehnquist and Atonin Scalia each wrote dissenting opinions about this case. In Rehnquists dissenting opinion, his main point upon which he disagrees with OConnor is that the right to an abortion is not fundamental. By this statement Rehnquist means that the word liberty in the Due Process Clause of the Fourteenth Amendment does not encompass the right to an abortion because the right to an abortion is not implicit in the concept of ordered liberty. Thus, he does not agree with the majority opinion. Scalia disagreed with OConnor and the majority about roughly the same point Rehnquist described in his dissenting opinion. The difference in Scalias opinion is that he believes there is no question that the right to an abortion is a liberty, but he states that it is not a liberty that is protected by the Constitution. Out of these three justices, Sandra Day OConnor would most agree with Tribe and Dorfs essay about how to read and interpret the Constitution. I believe she would be in agreement with them because unlike Rehnquist and Scalia, it seems that she interpreted the Constitution not by what she thought the framers originally meant, but by what she thought would do some good in the future. She also made it clear in her writing that the decision by the majority was not made based on the justices personal beliefs. She shows this in the majority opinion she wrote, the stronger argument is for affirming Roes central holding, with whatever degree of personal reluctance any of us may have, not for overruling it.

Mark Mathabane’s Kaffir Boy Essay Racial Discrimination, has already been a long term phenomenon, in existent in almost all societies in different eras and civilization. The idea of discrimination is inevitable. Considering that such discrimination creates social structure as regards what is expected of everybody in a society and what is due to them. However, sometimes this social structure is abused, beyond its limit. People who belong to a higher status quo would definitely do whatever it takes to keep it. To illustrate, colonizers who had way better technology, combat powers and knowledge as compared to areas being colonized, would come to these new conquests are superiors. They would then take the locals as slaves and ravish on the wealth that they have to offer. In their own place, these locals become discriminated and unwanted. In return, locals would do whatever it takes to associate themselves with the colonizers, by looking like them, being friends with them, working for them, or marrying people of their kind. And it always seems that it is the right thing to do. When the British came to South Africa, this is exactly what happened. Mark Mathabane’s Kaffir Boy, tells a real story of a man who chose to fight a different battle to combat discrimination and inequality. While most of his relatives act as freedom fighters, he came to America to educate himself and to excel in a sport he loves. His success has given so much inspiration. His story as depicted in his book will take us with him as he reveals the horrors of his past. Mark Mathabane lived in a country, wherein racial divide, for most of its early years seemed to be the only thing that defines them. South Africa, a country nestled in the continent of Africa, was once invaded by white colonizers too. And they have proven that they came there to stay. In a country such as South Africa, a nation so unique as compared to other nations in the African continent. South Africa can be considered as diverse in a special way, because it is the only African country that has Caucasians as locals. Originally dominated by black Americans, South Africa is now a melting pot of two cultures. Analysis It had never occurred to me that though the two were different as night and day, as separate as east and -west, they had everything to do with each other; that one could not be without the other (94) This statement from Johannes best explains the struggles of Mathabane. In summary it explains how the two dominant races in South Africa has tried to isolate each group against each other, by means of creating physical division such as creating boundaries and naming certain places as black or white territory. Whites are in a way regarded more superior because they are more literate as well. The government also used formal means to strengthen the divide by creating laws such as prohibiting mix marriages, and creating policies in the education system that seems to favor a specific race. Overall, it was almost the generally accepted norm, to- categorize, discriminate. Kaffir Boy, is a tale about Mark Mathabane’s life growing up in South Africa, just outside of Johannesburg. Mark Mathabane lives in the town of Alexandra during industrial colonialism period with his parents, five sisters and a brother. He talks about how he experienced brutality and starvation from the Peri Urban, an Apartheid police group in South Africa. Growing up very poor, he dreamt of having a better life for him and his family. He often questioned the prejudices happening around him and has decided to take the course of his destiny in his own hands. As a young boy, he struggled with his identity. He wonders which religion he should practice, which country or class he should belong. There is so much craving for autonomy that at a young age he began resenting his parents religious and tribal heritage and eventually decided to leave Africa. Believing that religion, specifically Christianity was used wrongfully by different groups and races, he eventually rejected it. He believes that government used it to claim that God had given whites the divine right to rule over blacks; the black churches misused it by demanding money from Africans who were already destitute; and black churches further misused it by resigning themselves to the idea that this was their lot in life, Gods will for black men and women (36). Mathabane also recalled how apartheid made use of tribalism as form of torture against Africans. He believes that his father, allowed himself to be controlled by superstitions, Relatively mature for his age, he reiterates his independence by doing what he pleases with his life. For Mathabane, the Christian God is bias in favor of the whites and is oblivious to the Africans pain. Although he recognizes its legitimacy as sign of respect for her mothers faith, he still rejects it the way he rejects tribalism and African superstition. For him, submitting to any specific belief or religion is synonymous with compromising his free will. In page 208 of the book he further on states African superstition and tribal culture were not for him. His scorn for his father lay in the fact that his father clung to values which had outlived their usefulness, values which discriminated against him while he attempted to function within the white mans world (208). â€Å"What Mathabane did accept, though it took some trial and error, was his mothers understanding that education would lead him to a better life. Learning English, he decided, was the crucial key to unlocking the doors of the white world (193). The books that white people read led to the power they had over black people (254). Mathabane eventually decided that literacy was a necessary element in the liberation struggle. How can the illiterate function, he wondered, in a world ruled by signs (201) Books had taught him about places where he could be free to think and feel the way I want, instead of the way apartheid wants (254). He then realizes that he needs to make important decisions in order to make his dreams come true. Thinking that South Africa has nothing much to offer, at least for a poor black African boy like him, he decided to try his luck with American Universities. As he begins to plot his future, his tennis abilities begin to progress faster and better. Being an avid fan of Arthur Ashe, he takes his wins and losses as if his own. The achievements of his â€Å"idol† encourages him to do better every single day. From black state competitions, he started joining the more prestigious white state competitions. His participation in white state competitions led to his banning from joining black state competitions. At this point, he feels as if his progress in his craft takes him away from the things he loved the most. Luckily, Mark later on leaves for the United States as a university scholar, through the help of a famous American tennis player and other white donors. Conclusion Deep within me,I knew that I could never really leave South Africa or Alexandra. I was Alexandra, I was South Africa (348). This goes to show that despite of all the successes, the author looks back in his roots. At first, his move out of Africa was just his way of â€Å"escaping† the endless circle of failed dreams and lack of opportunities. But his absence in his country makes him reaffirm his identity, and gives him the opportunity, to finally appreciate what his past has to offer for his present and for his future. This book tells a very dark story filled with pain, sadness and loneliness on most of its chapters, but it also provides a strong foundation for the readers to further understand the plight of the narrator. The journey he took was not only of hope, but rather, a journey of rediscovery. How can the illiterate function, he wondered, in a world ruled by signs (201)? The books had taught him and transported him to places where he could be free to think and feel the way I want, instead of the way apartheid wants (254). Why burn the only thing that taught one to believe in the future, to fight for ones right to live in freedom and dignity? (285). Here reaffirms his conclusion as we experiences Soweto riots, which was triggered by resentment over the governments ruling that African education system be taught it Afrikaans instead of English. Upon witnessing the library burn down he inquired for enlightenment from one of his peers, who mentioned that the burning is for the destruction of all the traces of white oppression in the Bantu Education system. The struggles in his youth, leads him to think that literacy is the key to success. by learning English, he will be given better opportunities, the same as the whites. According to the author, literacy has given the whites so much edge and power over the black Africans. Having an education will somehow even out the playing field. Literacy for Mathabane is so important, that for him this will eventually lead them to be liberated from all their struggles. In the end, we really have no control over our government, over the people around us, and over norms and traditions we grew up with. But we do have full control over our perspective, our feelings and destiny. And this is precisely what Mathabane did. He took charge of his own future. This book inspires me to examine the choices I have made as a young person, at the same time, it makes me wonder whether the previous steps I have taken in life will take me closer to my aspirations or take me farther. But then, it makes me think deeper not just about my ambitions, but what I really want to contribute to my society in the end. This book serves as a wake up call. In a society wherein we are given so much opportunity, it seems as if we are left with no excuses not to excel. Reference: Mark Mathabane, 1998, Kaffir Boy, Simon Schuster Adult Publishing Group

The Impacts Of Melting Glacier Environmental Sciences Essay

The Impacts Of Melting Glacier Environmental Sciences Essay It is clear that the earth is getting hotter due to global warming. It was proved that the amount of CO2 in the atmosphere had increased from 316 ppm in 1958 to 385 ppm in 2008 (Kirkham 2011, p.370) leading to the Greenhouse effects and causing many environmental issues as well as especially worsening the issue of melting glaciers. Many researches have showed that glaciers are melting rapidly and it is unlikely to slower down. Take Greenland as an example. On the eighth of July 2012, the percentage of glacier melting in this country was forty percent. However, four days later, this figure had jumped to ninety-seven percent (Kerthan 2012) (see Appendix 1). As a result, a serious flooding occurred in Greenland recently. This country contains ten percent of the worlds fresh water; yet, all the glaciers are melting and it is expected that by the end of this century, the sea level will have risen by eighteen to fifty-nine centimeters (Miller and Spoolman 2011). The flood happened in Kangerlussuaq, has swept away an important bridge and the busiest commercial airports of the island (The Guardian 2012). Greenland is just one example out of lots of other countries which are suffering from disasters because of glacier melting that threatens their food source including crops and animals, and even worse, destroys their homes. In the following part, the effects of glacier melting on human life, particularly food sources will be enlightened with supporting specific evidences and information. The impacts of melting glacier Today, the increasing temperature is causing ice caps on Mount Kilimanjaro and ice sheets in Antarctica and Greenland to melt (Lovgren 2004a) (see Appendix 2). This has resulted in the rise in sea level, causing many problems to the nature balance. Cold water fish cannot survive and even coral reefs are dying as the water is becoming too warm. This causes problems for people fishing them as a food source and influences the fisheries in general. Besides, Lovgren (2004b) said that the rising sea level can have serious impacts on low-lying countries, some of which like Indian Oceans Maldives or Nile Delta could be submerged. Not only will fishing be affected but people will also have difficulties in finding higher ground for living. An imbalance in natures food chain would be caused by global warming. As ice sheets melt in the Antarctic, the polar bears would be adversely affected since the temperature is too warm for them to live. Polar bears are entirely dependent on sea ice, you lose sea ice, you lose polar bears (Malcolm 2004). Additionally, the seal and sea lion population that would otherwise be controlled by polar bears as part of their diet would multiply and overpopulation may occur, causing many fishes being eaten and depleted. This depletion affects fisheries and people living in the northern hemisphere because they must then find other food sources which would be difficult as their main source of protein and food are fish. It is interesting that the glacial melting is the reason of two opposite effects: floods and drought (Mathias 2012). However, they are all connected. The fast glacier melting will lead to sudden increase in water input to rivers, causing flood all along the rivers (Mathias 2012). Floods could impact seriously on crops growth, it can have a negative effect on the financial performance of farming as a result of crop damage à ¢Ã¢â€š ¬Ã‚ ¦ reduced crop and livestock yield and quality/condition (Thorne et al. 2007, p.130). Therefore, our food sources are threatened seriously. For instance, a recent flooding this year in Burma has driven eighty-five thousands of people homeless and more than two hundred thousand hectares of rice field swamped (The Guardian 2012). In contrast, drought is a big problem in other countries because glacier melting changes the currents of the oceans cold and warm water. It changes the wind patterns that move cloud and humidity through the air, causing the imbalance in water distribution (Britney 2012). Since May this year, North Korea has been suffering the most severe drought in 105 years which threatened to damage this countrys breadbasket. The area was also notified an estimated amount of 3.5 million people are with the risk of malnutrition and famine (The Telegraph 2012). Furthermore, the rise in sea level caused by melting glacier also leads to the intrusion of sea water. This has affected the fresh water and land used for living and agriculture. For example, in Thatta, a major agricultural area in Pakistan, the amount of land suitable for agriculture has shown a significant decrease. Around one third of fertile land and cultivated areas there have been affected by the seawater intrusion (Emerton 2005). This causes losses for crops and serious damages to livestock due to the shortage of pasture, rangeland, and fresh water needed for cattle rearing. Impacts on rice cultivation may be the most noticeable. As rice is a salt-sensitive crop (Adger et al. 2001a, p.248), the increased salinity in soil can hinder rice growth and affect rice production. World Bank (2000) indicated that increased salinity alone from a 0.3 meter sea level rise will cause a net decrease of 0.5 million metric tons of rice production (cited in Sarwar 2005, p.19). For example, this salinity intrusion caused 50% to 90% drop in rice productivity over the past three decades in Tra Vinh province of Vietnam (Hopkins 1995, cited in Adger et al. 2001b, p.248). Additionally, the rising sea level also influences fresh water fish. Liu and Esogbue (1999a, p.121) said that sea level rise will, in all likelihood, bring about a reduction in the freshwater habitat conditions particularly in the rivers. In the event of such a situation, production of fresh water fisheswhich cannot tolerate any level of salinity in the water is likely to suffer. In places where pond or lake fishery provides the major source of food and income, may face many difficulties if the sea level continues increasing. For instance, Liu and Esogbue(1999b) shown that in many coastal districts of Bangladesh, carps is a major agricultural product and pond culture of carps is widely practised. According to the authors, there were totally 105.5 thousand metric tons of carps produced in freshwater ponds of those districts between the years of 1995 and 1996. So, the rise in sea level may lead to these ponds being submerged, causing huge losses in carp production. Solutions for the issue of melting glacier The only way to slow down glacial melting is to slow down global warming. There are many measures having been done. Humankind depends on burning fossil fuels for power, but it increases global warming. To restore the glaciers we should increase energy efficiency and utilize alternative energy like wind power, solar energy, or biofuel (Leon 2008). Technology innovation like Chlorine-free paper and Greenfreeze solution which is adopted in refrigeration manufacturing to avoid CFCs a chemical affecting ozone layer (Rose 2010) also helps slow down global warming. Additionally, treaties like Global Black-Carbon or Global Carbon Tax are formed to engage countries in the emissions reduction (Dauncey 2009a). For example, Kyoto Protocol, an international agreement established in 1997, sets targets for 37 industrialized countries and European community to reduce their greenhouse gases emissions. (Leimkuhler 2010). Other solutions include protecting the world forests and grasslands, establishing the global climate funds to assist poor countries in adopting climate-friendly technologies. In a national scope, governments encourage their citizens to use greener energy by establishing solar villages like those in Bangladesh or ecological capitals like those in Colombia and Brazil (Dauncey 2009b). All the solutions need public support, so governments must educate and convince their people to follow the climate-friendly strategies. Besides, they need to support citizens organizations that are taking practical actions to promote and build a greener society (Dauncey 2009c). Conclusion To conclude, problems of melting glacier will still happen in the future because continued increases in global temperature will accelerate the rate of glacier melt, sea ice retreat, and melting of the ice caps (Dawson and Spannagle 2009, p.334). Many studies have shown that the earths temperature will continue increasing for some reasons. Reducing greenhouse gases faces many difficulties as our modern society will still depend on fossil fuels for energy (Seeds and Backman 2010, Armstrong and Howarth 2005). Claussen (2001, pp.83-84) stated that the emissions growth in Argentina, Brazil, China, India, and Korea will increase by two-thirds by 2015 under the most optimistic scenarios. Based on analysis of gases emission, the Intergovernmental Panel on Climate Change (2007) estimates that the global temperature may show a rise of 2 °C to 6 °C by the end of this 21st century (cited in Holt and West 2011, p.141). Besides, even if greenhouse gases are stabilized, global air temperature and sea level are expected to continue to rise for hundreds of years (Mooney et al. 2010a, p.481). The authors explanation for this is that the present global warming will lead to further warming of the earth. For instance, the melting of ice will expose land and ocean area below which normally captures more heat than the ice, causing a warmer planet (Mooney et al. 2010b). Global warming results in melting glacier. When the earths temperature continue rising in years to come, the glaciers will keep melting in a faster manner than it used to, just like what Meier and Dyurgerov (2005) stated glacier ice melt is accelerating in recent years, and is likely to continue at a high rate into the future (cited in Braasch and McKibben 2009, p.40).

The Merchant of Venice Essay example -- Merchant of Venice Essays

William Shakespeare’s The Merchant of Venice is one of his most controversial plays for a variety of reasons. Written in sixteenth-century England, where anti-Semitism was common and the presence of Jews was not, the play poses many questions concerning racial, religious and human difference. The play is especially tricky to examine in today’s society, as its anti-Semitic themes and language can be uncomfortable to face in a world post-Holocaust. Additionally, the depiction of the relationship between Jews and Christians, which has always been an ambivalent one, adds a very interesting albeit difficult dimension to this play. Ultimately, through dramatic plot and distinctive characters, The Merchant of Venice explores what it means to be Jewish and what it means to be Christian. A closer analysis of these opposing groups unearths inconsistencies between what the characters preach versus what they practice, as well as their problematic notions of justice, mercy and love. Though he clearly fulfills the role of the villain and main antagonist in this play, the character of Shylock is extremely complex and multi-dimensional. He seems to have two sides that can be emphasized or played up in order to create a fundamentally different play, as has been done many times throughout history; post-Holocaust reproductions, for example, are obviously radically unlike than ones that may have come before (Rich 1). In most modern adaptations, Shylock is seen as a sympathetic character, perhaps due in part to the widespread acceptance in most modern societies of those from varying religious and racial backgrounds. However, it is entirely possible that Shakespeare, who was a genius playwright famous for his complex and multi-faceted characters, del... ... actually considered this a happy ending for the Shylock character (4); by converting he is â€Å"saved† from the possibility that â€Å"misfortune [may] cross†¦ / †¦ a faithless Jew† (2.4.35-37). This paper barely scratched the surface of the religious and moral complexity that is The Merchant of Venice, but it is clearly a complicated play and for many reasons: the racially charged tension, the anti-Semitic language and the morally ambiguous characters. What makes this play so exciting is that it provides neither answers nor apologies, provoking the ongoing disagreement as to what is really happening in this play. Shakespeare’s multi-layered characters and complicated representations of mercy, justice, love, religion and difference produce a remarkable piece of work that has kept people talking and guessing for centuries, and is sure to continue to for centuries to come.

Disguise in Shakespeares Measure for Measure and Twelfth Night Essays

Disguise in Shakespeare's Measure for Measure and Twelfth Night      Ã‚  Ã‚  Ã‚   Disguise is a device Shakespeare employs frequently in both Measure for Measure and Twelfth Night. It allows a disguised character like the Duke of Vienna to glean information that would otherwise go unknown, and a character like Viola to take advantage of potentially beneficial situations. It gives these characters access to worlds that might otherwise be denied; for the Duke, he can now "haunt assemblies / Where youth and cost a witless bravery keeps" (1.4.9-10). For Viola, she might "serve the duke" (1.2.51) and thus hopefully keep company with Olivia, who also lost a brother. Disguise is especially appropriate in the worlds that exist in the two plays: they are characterized by excess and inversion of proper order. In Measure for Measure, the Duke leaves his kingdom unexpectedly in the hands of a deputy; the inversion is continued by the unprecedented harsh enforcement of the law, something that hasn't been done in fourteen years. In Twelfth Night, the title itself suggests a last hurrah, the end of the carnival, and Viola personifies this last wildness by taking on a role opposite in gender to her natural one: she plays a man.    Michael Margan in "Laughter and Elizabethan Society" glosses Mikhail Bakhtin, saying that the laughter of carnival is "an ambivalent laughter, simultaneously celebrating and mocking, sympathizing and deriding" (34). Laughter, comedy, and a world turned upside-down characterize Twelfth Night, Or What You Will, and allow Viola to successfully don her "masculine usurped attire" (5.1.248) and win Olivia's hear... ... city. Donning a disguise to suit the moment does not change the person, however adaptable and convenient it may be to achieve certain ends. The Duke of Vienna tells Isabella that though he removes his friar's robe he is "not changing heart with habit" (5.1.381), and Viola laments that "My state is desperate for my master's love" (2.2.37). Just as carnival and misrule only have a limited reign, so their disguises only alter Viola and Vienna temporarily. Works Cited Margan, Michael. The Role of Counseling :: essays papers

The Role of Counseling A study performed in 1992, reported approximately 3,400,000 youth had failed to complete high school and were not enrolled in high school (Starr 1998). This statistic is based on the United States where job competition has greatly increased due to technology. Many of these student lacked the support and training necessary to succeed in today’s society. Currently in every high school across the nation, there is a person responsible for offering support and training to the youth of America. Available for all students is a guidance counselor. Counselors within the high school setting play an influential role in the forming of post high school goals through the planning of numerous activities. Education Week reported in the â€Å"Metropolitan Life Survey of the American Teacher 2000† that seventy-one percent of students state their post-high school plans as a four-year college (Eduacation Week, 2000). The fact is seventy-five percent of Americans youth do not graduate from college (Starr, 1998). Due to the inconsistency of the reported statistics a counselor needs to advise each student in the direction that best suits them. This task is difficult considering the large number of students per counselor. Counselors are able to advise more students through planned activities (Ordsmyth, 2002). There is also the need to support students through the transitional stage between significant events. Preparing a student to enter a four-year college, two-year college, military or job force is crucial to their future success. Ways to Prepare the Student A guidance counselor is an important element in the formation of post high school plans. Counselors offer an outlet of information that should be used by all students. There are numerous ways for the counselor to approach post high school planning. One technique is the writing of an essay about their ideal school (Marthers, 1997). This idea was developed by, Paul Marthers, in hopes that conversation would be stimulated. A student involved in the college search should focus on their desires pertaining to college. A study by Nafziger, Holland and Gotffredon, in 1975, indicated the improbability of a student leaving a school that matches their personality type; therefore the importance of the college search is highlighted (Marthers, 1997). Starting the college search with a positive outlook will affect the entire process (Marthers, 1997). Goodnough and Ripley are also accredited with a technique beneficial to post- high school planning (1997).

Gender Equality Essay

Paying more attention to the differences between boys and girls, or men and women, starts getting people to have many ideas about them. The question remains whether we should ignore them or not. I don’t blame the family in the rural Canada for making the girl feel like she’s nothing more than just a girl, because simply these people there could be ignorant. There is a difference of course between men and women, but not that one is inferior to the other, rather as equal but distinct beings. Right before writing my opinion about boys and girls, I asked my dad whether he though there was a difference, and that maybe a girl is a girl because of influence and experience. He told me how he used to take my sister and me to Toys‘r’Us when we were small. He would bring us to what he thought were the cool toys such as mechanical gadgets and how we wouldn’t even look at them and directly walk off like zombies to the Barbie section. This explains how maybe it is in our genes, which bring off a kind of barrier, a difference between a boy, and a girl. Now maybe feminists take it a little to the extreme about female rights, but isn’t that because people (mostly men) have taken the difference between boys and girls to an extent where they forget about equality and what woman are really capable of doing? I still believe that there are many ways of stereotyping men and women these days, even as distinct as they were in the rural Canada in the selection. It is possible, but I believe the more educated we are, the less we will care about whether we are a man or a woman. In some countries, it is the communities’ traditions which still give to men more rights and privileges than to women. This is mostly because people in those areas are not yet socially evolved to the Western level. For example, in Saudi Arabia woman wont dare revolt or express their ideas of what’s really unfair or unethical to them or not. We need to stop buying into the myth about gender equality. It isn’t a reality yet. Today, women make up half of the U.S. workforce, but the average working woman earns only 77 percent of what the average working man makes. But unless women and men both say this is unacceptable, things will not change. Men have to demand that their wives, daughters, mothers and sisters earn more—commensurate with their qualifications and not their gender. Equality will be achieved when men and women are granted equal pay and equal respect. Humanity requires both men and women, and we are equally important and need one another. So why are we viewed as less than equal? These old attitudes are drilled into us from the very beginning. We have to teach our boys the rules of equality and respect, so that as they grow up, gender equality becomes a natural way of life. And we have to teach our girls that they can reach as high as humanly possible. We have a lot of work to do, but we can get there if we work together. Women are more than 50 percent of the population and more than 50 percent of the voters. We must demand that we all receive 100 percent of the opportunities.

Fashion “The Craze Among Youth”.

Every person Is fashion conscious. Fashion Is very popular among the school boys and girls, They do It in a competitive spirit to look smart. up-to-date and attractive. Students like actors and actresses. Some of them see a film to copy the latest fashion. It is mostly the college students who look upon fashion as the very stuff of their conscience. Being fashionable Is the only real passport to high society and popularity In the college. Students put on expensive and fascinating clothes of the latest cut, color and design. The students spend a lot ot money on clothes and other things In ife for sake of variety. They do not realize that they are wasting their precious time and energy in this effort. In addition, they waste the hard-earned money of their parents. Students have become crazy after fashion. But this is all being done at the cost of their studies. They are wasting the precious time of their life. Sometimes, poor parents are burdened with fashion bills. 853 Words Free Sampl e Essay on Fashion Thus, every one should try to have some leisure and make the best use of it by taking to some good hobby or the other. Great caution should be exercised; in choosing a hobby. We should choose a hobby which recoups our energy and provides relaxation and recreation. Young people all over the world are becoming more and more fashion conscious. Young students, whether boys or girls, are crazy about it they want to look smart and beautiful by wearing dresses of the latest designs. In order to boost the sales of their dresses, leading cloth mills and dress†making firms engage reputed fashion designers and beautiful models. Fashion parades and shows are held In big five star hotels to exhibit the latest dresses.Fashion Is no longer the monopoly of women. Even men have great fancy for It. In fact, the latest unl-sex dresses Ilke shirts and Jeans can be worn both by the girls and the boys. Today, the biggest centers of the latest fashions in the world are Paris, Londo n, Hollywood and New York. In India, Mumbai. Delhi, Chandigarh, Lucknow, Jaipur, Shimla etc. have become centers of high fashion. Students generally try to copy fashions from films. Fashion has permeated all spheres of our life. It is followed not only in clothes but also in hair-styles, shoes, etiquette or manners. Some people are content to wear fashionable clothes. Others go In for fashionable hair-styles. ull others adopt the latest trend In their speech and manner. All these people want to look impressive and attract the attention ot others. They want to look different in the eyes of others. Fashion is neither stable nor eternal. It is ever-changing. The change in fashion takes place so fast that people sometimes find it very difficult to catch up with it Students in India also have become quite fashion conscious. In a college campus, one can see both girls and boys wearing all types of clothes. Girls wear whatever their favorite heroines wear. Boys try to emulate their favorite heroes. Fashion knows no frontiers. It travels across countries very fast. when students In India see latest foreign films from Hollywood, they adopt the latest fashions from these films. They even imitate the way of life, speech, manners, actions, clothes, hair-styles of their favorite foreign actors and actresses. Some students spend a lot of money and devote considerable time on their make-up.They neglect their studies Their books gather dust These students hardly realist that by neglecting their studies, they are ruining their own career. ‘ Of2 students oTten seem to surer Trom a mlstaKen notlon tnat Tasnlon means wearing lothes and other costly items like Jewellery, etc. The fact is that sometimes expensive clothes and heavy make-up may prove counterproductive. It may even have a negative effect on one's personality. Some people look smarter in simple clothes than in expensive clothes. As the old saying goes, beauty needs no ornaments. In fact simplicity is the best fashio n, If students pursue fashion at the cost of their education, they will be left behind in their studies. This will spoil their prospects of a bright future. If they want to be successful in life, their motto should not be fashion but ‘simple living and high thinking. Unfortunately, college boys and girls have started regarding even smoking as a fashion. One can see a number of boys and girls sitting in college restaurants and enjoying a smoke. Those who have costly brands of cigarette packets and imported cigarette lighters feel proud. Some students go to the extent of taking intoxicating drugs like ‘heroin', LSD, Hashish, Marijuana, etc. Drinking is also considered as a symbol of modern society and high fashion. These habits adversely affect the health of students. A conscious effort should be made both by the teachers and parents to dissuade their children from falling prey to these anti- ocial habits in the name of fashion. No doubt fashion spreads like wild fire especi ally when fashion critics hail any new design as ultra modern. Slowly a fashion percolates first to the middle- class families and then to the poor strata of society. Once it becomes common, it loses its novelty. Fashion conscious boys and girls then look out for something else which is new and exclusive. But â€Å"fashion† should not be given wide meaning so as to include everything which is being followed in western countries. Due respect should be paid to one's native countrys way of living also.Whether the influence of western culture is a boon or a curse to the Indian youth, is a controversial topic. No culture is good or bad. After all, every culture is an educative refinement, a product of an era. It is the understanding of a culture and methods of pursuing it that can make it good or bad in the eyes of other people. Thus, it cannot be concluded that every western influence is harmful. Indian youth, instead of following the west blindly, should try to grasp the very es sence of western culture and help it in enriching his own. Only then can true development take place.

Michael Ondaatje’s “Elizabeth” Essay

Michael Ondaatje’s â€Å"Elizabeth† portrays the life of the English Queen Elizabeth I. Ondaatje fuses prose and poetry, fact and fiction, realism and surrealism. The effect of this fusion creates a high degree of dramatic realism. It illustrates the progression and transition from childhood to adulthood. The Poem opens with a young Elizabeth harvesting apples with her father (King Henry VIII) and Uncle Jack (fictional character); preceded by a trip to the zoo. The atmosphere suddenly shifts from going to the zoo, to ice fishing with Philip (King of Spain) on a cold winter day. Abruptly, the atmosphere and time shifts again to describing Mary’s (Elizabeth’s stepsister) teeth. Then jumps to a dancing scene with Elizabeth’s confidant, Tom (Lord Thomas Seymour), which is followed by the execution of Tom. Finally, the poem ends with a rather short description of Elizabeth writing poems with another confidant, the Earl of Essex. The narrative lines and descriptive passages employed in â€Å"Elizabeth† do not flow logically and coherently from point A to point B. The names do not appear to be in historical and chronological order; however, they fit into a generalized image of the political mayhem, betrayal, and punishments of that time. Elizabeth’s stepsister â€Å"ËÅ"Bloody’ Mary Tudor, Mary’s husband Philip II of Spain, the unfortunate Lord Tom Seymour, and her late favorite, the Earl of Essex, were all executed. Ondaatje’s â€Å"Elizabeth† alters from child-voice through adolescent-voice to adult-voice, catching the tone of each stage of maturity. Ondaatje’s imitation of the tones shows how Elizabeth must, through debilitating maturity and complex situations, sacrifice passion to power, as how a young ruler would have to. For example in stanza three, Philip â€Å"broke the ice†(19) and â€Å"then he [Philip] kissed me [Elizabeth]†(22), suggests that love is deceitful, and is to be avoided. Furthermore in stanza five, â€Å"I kept the love in my palm till it blistered†(34) connotes that love is painful and not time-worthy. Death is present and apparent in last stanzas as both threat and momento mori (remembrance for the dead), even to the young mischievous girl who â€Å"hid the apple in my room/ till it shrunk like a face/  growing eyes and teeth ribs†(7-9). The symbolic references to â€Å"apple†(2) and â€Å"snake†(12) conjure up the relationship between Elizabeth’s life to that of Adam’s and Eve’s. The evil, deceptive snake in Adam and Eve convinces Eve to eat the apple, which in the end leads to her downfall. Elizabeth’s father, King Henry VIII of England, compliments and sides with snake in the zoo, by describing it as â€Å"Smart†(16). This siding of the snake might indicate to the readers of the residing evil within him. In stanza three, the image of ice fishing and eating raw, uncooked fish implies a primitive and uncivilized way of living. A primitive life is a dangerous one. The correlation between the snake, the father, and the primitiveness can lead to a sense of danger in Elizabeth’s life. Elizabeth senses the danger and evades it by becoming sly and controlling. This is indicated by the tonal transition in as she slides from thoughts of â€Å"Tom, soft laughing†(28) and â€Å"turning / with the rhythm of the sun on warped branches, / who’d hold my breast and watch it move like a snail / leaving his quick urgent love in my palm†(30-34), to his beheading, and finally to her later â€Å"cool†(44) flirtations â€Å"with white young Essex (45). Nevertheless, Elizabeth’s control of voice captures the readers’ attention. â€Å"Elizabeth† is one example of Ondaatje’s attempts to defy traditional poetry writing. And he achieves it in the incoherency of events, the un-rhythmic lines and the irregular stanzas.

Coppola’s first feature film Essay

Similarly, the 1992 adaptation of Bram Stoker’s Dracula by Francis Ford Coppola has an equally complex representation of Dracula. Francis Ford Coppola was born in 1939 in Detroit, USA, but he grew up in a New York suburb in a creative, supportive Italian-American family. His father was a composer and musician, while his mother had been an actress. Francis Ford Coppola graduated with a degree in drama from Hofstra University, and did graduate work at UCLA in filmmaking. He was training as assistant with filmmaker Roger Corman, working in such capacities as soundman, dialogue director, associate producer and, eventually, director of Dementia 13 (1963), Coppola’s first feature film. In Francis Ford Coppola’s representation of Bram Stoker’s Dracula, he chose to portray a typically evil creature as a complicated, ominous yet sensitive individual. In this interpretation, Dracula apparently has human emotions; he is feeling what humans feel. He tried to suck Jonathan Harker’s fianci e’s blood but is overcome by emotions and memories of his dead wife, and spares her for the time being. He also has human urges, both physically and mentally. But despite how humanlike Dracula may seem in this version of Dracula, he is still surrounded by the obvious evidence that point to the evil part of his person . He is dressed in red and black robes which connote blood and sinister-like things. But his polite voice is used as a withdrawal from his unnatural aura. He has weathered and very pale skin which emphasizes the connotations of blood, and ghostlike hair that match the colour of his skin. Also, his ability to take on any form facilitates the fact that he is a sinister character. Also, the mis-on-scene on various occasions make Dracula seem even more sinister than normal. The music alternates, the lighting is dim on a close up shot which creates a sense of concealment and makes the viewer use their imagination. Despite this, Dracula’s distressed emotional state might make the viewer sympathise with him. This interpretation of Dracula by Francis Ford Coppola would be suitable for an even more modern audience than Nosferatu and Hammer Horror’s version. The viewers of this film will respond to it with a variety of emotions. They might have been frightened of Dracula because of his ability to transform and take on any form which might spark a sense of paranoia within their minds and make them think that anyone around them could be Dracula himself. But they might also sympathise with Dracula because of his traumatic loss, and might feel a connection with him as they might know how he feels, loosing a loved one. They could view him as a strong-willed and self-controlling villain because it is unlikely for a vampire to resist the urge to bite into fresh skin, especially when it is offered to them on a plate just as Jonathan Harker’s wife was to Dracula. So why are those 3 representations of Bram Stoker’s Dracula so different? I think it’s due to the time when the movies were made. During the time when Nosferatu was made, the technology was terrible and nothing had been invented that could create a half-decent movie. But in Dracula (1952), technology had clearly developed which made it possible to create a movie including advanced special effects and costumes. Furthermore, in Francis Ford Coppola’s version in 1992, the technology had improved even more, making room for a movie that re-defines the quality and meaning of the movie: Dracula. Another reason why representations of Dracula changed overtime because people have come up with new ideas. I think this links in with the idea of what society are scared of, which is another reason why the representations of Dracula have changed overtime. This is because as society becomes scared of new things, then people have to come up with new ideas to satisfy the needs and wants of their audience. I think that Francis Ford Coppola’s representation of Bram Stoker’s Dracula is the most effective because he portrayed a typically evil being with characteristically no emotions, as a self-controlling and strong willed individual. He turned a villain that is most likely to be a hated icon amongst most people, to something that could draw the feeling of kindness and consideration from the viewers’ hearts, eradicating the fact that he is a blood-sucking villain that deserves to have a stake pushed through his seemingly heartless chest.

Communication And Newspaper Essay

Racism and sexism were a major part of the 1950s and 1960s, with very few newspapers or magazines being able to maintain neutrality in their printed word against such hate. The Watts riots of Los Angeles in the movie, Heat Wave, involved attacks of a bigoted police force against black individuals who had very little education, were living in poverty, with most of the people having no jobs–with unemployment being higher here than anywhere else. Many of these individuals felt they were being prejudiced against, with only five of the actual 205 police officers involved in the riots being African-American. In the movie, the Los Angeles Times reporter was played by Robert Richardson, as white reporters were not allowed in the area, which was a reverse discrimination of the riot itself. The whole picture was about racism, poverty, desperation, and feelings of anxiety and striking out against the world with feelings of   â€Å"enough is enough.† It also is about how someone in the lead role of a intolerant and racist police chief can influence whole neighborhoods of the African Americans, leading them to feelings of hopelessness and despair, eventually leading to the Watts riot which led to even more riots across the country as people began rebelling against their treatment. The movie Crash was also portrayed in Los Angeles, and also involves racism and prejudice. If possible, in a more dramatic way it regards how people interact with each other and how they develop a first impression based on race or statement, forming feelings of prejudice. It seems as if the movie is totally about relationships and different races of people, telling how we get all messed up inside and form wrong impressions about things that maybe later on we would never consider. The role of Officer Hanson in Crash psychologically seems to continue from the raging police in Heat Wave, yet here it shows that behind the scene of their abusive personality, it shows another side of racism in a different form of view, even though it brings up more violence and maybe other things causing it. It is a step-up in the picture of how discrimination, racism, and sexism develop in societies and within individuals. It is not always a black and white scene, but has many variables involved in it. In Crash, the viewpoint changed from the reporter’s view on how something can happen like a riot of minorities, or a car hi-jacking, as portrayed to the public or world to see how something can develop from the viewpoint of the stereotyped races—eventually even seeing things from the viewpoint of the police and why they feel the way they do. The third way of thinking refers to the scene in the movie Come See The Paradise, almost as if completing the circle of prejudice and racism. The writer of Crash felt that intolerance was a collective problem that needed to be explored along with shared humanity, almost as a â€Å"gang effect.† In the movie Come See The Paradise, Jack McGurn is a union organizer in New York City that is parallel to the police in the other two movies in regard to status and position, but finds himself on the wrong side of the law, also similar to the car hi-jackers or the rioters in the previous two movies. Fleeing to Los Angeles, he becomes involved in the Asia-American world, which involves racist and sexist as the blacks or Japanese, but he is the one who is prejudiced against when he tries to marry Lily, an Asian-American woman, by her father. The state of California also is prejudiced by their relationship by refusing to marry them, which forces them to flee to Seattle where they can wed. Prior to the prejudice and rioting of the 50s and 60s, â€Å"Civilian Exclusion Order No. 92† became the forced removal of all Japanese and Japanese-Americans from their homes into detention camps, with very few actually knowing where they were going or why. After WWII was over, and the Japanese Internment was actually admitting to as a wrong–doing by the United States, the Civil Liberties Act of 1988 was passed to make sure that the Japanese Americans were repaid for being locked up like criminals, during a time when prejudice and fear took away the rights of our citizens because they were of another nationality involved in a wrong-doing. This was a time when citizens of the United States lost their rights because of who their race was against the power of the United States. They literally had to stand in-line to toilet, to eat, were told when to go to bed, etc.—meanwhile losing their homes, jobs and many family members. Needless to say, their dignity and pride were torn away because they were Japanese, not because of what they did wrong. Similar to the African-American racist riots in the 1960s, with many of the blacks forced into jail and torn away from their homes because they were black, the Japanese were treated just as bad. The African-Americans targeted were jobless, homeless, and drifting throughout life—which were automatic red flags for white police to pick them up. During the Japanese Internment, just being Japanese was an automatic red flag to be put in detention camps during WWII. With about 120,000 of these Japanese-Americans being forced into the camps, it was held in little regard that 2/3 of them were actually American citizens, and had rights under our Constitution, even though they were a minority group. They simply were unlucky enough to be Japanese during a time when the bombing of Pearl Harbor occurred, and they became the focus of the United State’s hate and prejudice. Living in the camps for three years under armed guards, this became a shameful period for our country when we had the audacity to treat our own people this way when they had done nothing wrong other than become a victimized race.   At one time, the Constitution of the United States actually protected the rights of our citizens, but the perfect union was not perfect during this WWII period or even later on, as the minority groups became a separate entity during the WWII as opposed to being a citizen of respect, as did the African-Americans during a later period, and is to this day. In my opinion, the similarity of the Japanese Internment period and the rioting of the 50s and 60s have changed very little, with one group locked up in detention camps and the other in prison. Both groups are imprisoned more due to race and color, by ignorant and bigoted individuals of authority who choose to separate themselves from their victims as beings of superiority. Very few looked at their victims and ask, â€Å"what kind of life did they lead before this moment, and what led to this?† and â€Å"do they consider themselves as criminals and doing wrong, because they were born Japanese or Black?†Ã‚   And did any of the answers justify the actions of their jailers? Race and racism is part of the United States and has very little to do with ethics or morality of the human race. Do we have room for a neighbor of another nationality? No—at the present time due to 9/11 the same thing is happening. How many people who are of the same race as the terrorist groups, are being punished by the United States and its citizen, being questioned in detention camps year after year, and with torturous techniques labeled as acceptable by our President? How different is this from the Japanese Internment period, or the locking up and beating of the African-American people simply because they were overly populated, living in extreme poverty, or uneducated? It is not†¦and we repeat history again and again, never learning compassion or empathy, which is why we are so popular with third world countries that are uneducated, poverty stricken, and over-populated—and who we are 100% prejudiced against.    Bibilography There needs to be the information here of the newspaper coverage, â€Å"the Readings,, of the Japanese-American Intemment during WW2 and the civil Rights movement of the late 1950`s,† which I do not have.

Symbolism in Young Goodman Brown by Hawthorne Essay

Symbolism in Young Goodman Brown by Hawthorne - Essay Example Symbolism, most of which is spiritual, is used throughout the story to show the downfall of the once-holy community, including Goodman Brown. Faith is a symbol unto herself, from her name to the pink ribbons that she wore in her hair. As Goodman Brown sets out to meet with the devil, he talks himself into giving up such a horrid life for the sake of Faith. Whenever he thinks about the evil deed at hand, he allows his mind to turn back to Faith. This can be taken in two ways - Faith, as in his wife, and faith, as in his religious beliefs. Faith, his wife, is a personification of Goodman Brown’s spiritual faith. He does not want to live a life of evil, but one of good, religious faith. As such, Faith symbolizes Brown’s desire to live a religiously fulfilling life while also, while also wanting to remain good for the sake of his wife. Faith’s ribbons symbolizes Faith and her purity. The ribbons are pink, a color often associated with purity and innocence. As she say s goodbye to her husband as he leaves, Brown takes notice of the pink ribbons in her cap. At this moment in the story, Faith is pure and innocent. However, as Brown is wandering through the forest towards the evil gathering, he thinks he hears her voice, calls out to her, and then notices one of her pink ribbons falling from the sky. Since the ribbons symbolize purity, then as Faith loses her ribbons, she also loses her purity.

Evidence-Based Practice Project Assignment Example | Topics and Well Written Essays - 750 words

Evidence-Based Practice Project - Assignment Example There are five categories of adopters in this theory including earlier adopters, early majority, late majority and laggards (Sahin, 2006). In the implementation plan of the research geared towards understanding the use of echocardiography in the treatment of heart diseases, the diffusion of innovation theory will be helpful. From the PICOT questions, the target population is teenagers that suffer from heart problems to the extent that their productivity is affected. It is from this population that the five categories in the diffusion of innovation theory will be taken out from for the implementation plan. The intervention under the PICOT question is securing and protecting these teenagers from succumbing to heart problems through a research program that will provide the required information on the best way to solve the heart problems that they face. Here, the five-stage adoption process in the diffusion of innovation theory will be used in implementing the intervention in the five categories established from the chosen population. The first stage is knowledge or awareness stage (Sahin, 2006). In this stage of implement ation, I will search for information that will enable me to gain knowledge of the clinical change required for the teenagers. this will involve asking questions from professionals in the area and researching on the information. This stage will feature the comparison aspect of the PICOT question because information has to be compared in carrying out the study (Santos, Pimenta, & Nobre, 2007). The second stage is the persuasion or the interest stage. This stage involves gaining interest and persuasion about the advantages of the innovation (intervention). This will involve looking at the intervention both from the positive and negative side and weighing the two to determine whether the advantages are more than the disadvantages. This will lead to persuasion on exactly the side to take with regard to the intervention. This stage

I attach the file with options on the topic of the BOOK REVIEW Essay

I attach the file with options on the topic of the BOOK REVIEW - Essay Example Since the debate of left and right has been valid and intact for the last several decades, portraying the images of modern and conservative respectively while exercising power and ensuring good governance, the author strives to depict the realities, concepts and misconceptions associated with it in general in the contemporary times (67). Giddens claims that although modernity has made its sure headway, the imperative significance of traditionalism and conservatism could never be negated or refuted at any cost. It appears to be more explicit in the sense that the previous era rightists used to look for sticking to the age-old ways of life, and used to defend the patterns of their life in a conventional manner; nevertheless, the same characteristics have been shifted to the modern, or leftist, communities, which observe great perils regarding the spread of purported contemporary era radicalism (82–5). As a result, dealing with the radicals has turned out to be a great challenge for the peace-seeking political administrations. Hence, the western societies appear to be maintaining a defensive approach while supporting the modernity at the time when the purported radicals seem to be standing against modern patterns of life with the aim of crushing the ways that are contrary to the social norms and moral values abided by almost all societies of the world for the last centuries to go. Hence, the governments of the developed nations appear to be afraid of the consequences of the reaction of radicals to allowing such freedoms including extra-marital cohabitations, same-sex relationships and marriages, illegitimate pregnancies, government controlled economic activities and application of latest scientific and technological equipment on a massive scale. Thus, the political administrations have to undergo serious reservations because of the perils of a severe reaction to the modern ways of life from the radicals. One of the most distinguished characteristics attribu ted to the contemporary radicals includes their support of the free market instead of keeping their weight in favour of the government controlled economic system advocated by socialism to be the essential element of a welfare state (136–7). Hence, the concept of welfare state with regard to the socialist economic system seems to be opposed and rebutted by the present-day radicals, who used to organise demonstrations and launch social movements for immediate enforcement of the same (192). Therefore, power appears to be shifting from modernity to radicalism-conservatism in various parts of the globe, and the developed nations have to make strong decisions in order to combat with the opposition from radicals. The Marxist-Socialist perspective, Giddens asserts, looks retrospective while narrating the relation between man and
